Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Reelactive ("Service"), a SaaS platform operated at reelactive.ai that generates Instagram carousel posts and auto-publishes them on behalf of users. By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 16 years of age to use Reelactive. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Your Account

To use certain features of the Service, you must create an account by providing your name and email address. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Service Description

Reelactive provides the following core functionality:

• AI-powered generation of Instagram carousel post content based on your business profile, description, and target audience.
• Automated publishing of carousel posts to your connected Instagram account via the Instagram Graph API.
• Scheduling and management of your content calendar.
• Image upload and management for use in carousel posts.

5. Instagram Integration and OAuth

To use the auto-publishing feature, you must connect your Instagram account via OAuth. By doing so, you:

• Authorize Reelactive to publish content to your Instagram account on your behalf.
• Acknowledge that you are the authorized owner or administrator of the connected Instagram account.
• Agree that content published through Reelactive must comply with Instagram's Terms of Use and Community Guidelines.
• Understand that you can revoke access at any time by disconnecting your Instagram account from Reelactive or through your Meta account settings.

Reelactive is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram. We are not responsible for changes to Instagram's API, policies, or service availability that may affect the functionality of our Service.

6. User Content

"User Content" refers to any content you provide, including business profile information, uploaded images, and any text you input.

• You retain ownership of your User Content.
• You grant Reelactive a non-exclusive, worldwide, royalty-free license to use, process, and display your User Content solely for the purpose of providing the Service.
• You represent and warrant that you have all rights necessary to upload and publish your User Content, and that it does not infringe on any third-party rights.
• You are solely responsible for all content published to your Instagram account through Reelactive.

7. AI-Generated Content

Reelactive uses artificial intelligence to generate carousel content. While we strive to produce high-quality, relevant content, you acknowledge that AI-generated content may occasionally contain errors, inaccuracies, or content that does not perfectly align with your expectations. You are responsible for reviewing generated content before it is published. Reelactive is not liable for any consequences arising from the publication of AI-generated content to your Instagram account.

8. Payment and Subscriptions

• Certain features of the Service require a paid subscription. Subscription plans and pricing are listed on our website.
• Payments are processed securely through Stripe. We do not store your credit card details on our servers.
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial periods.
• We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

9. Prohibited Uses

You agree not to use the Service to:

• Publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Infringe upon the intellectual property rights of others.
• Distribute spam, phishing content, or misleading material.
• Attempt to gain unauthorized access to the Service or its systems.
• Use the Service in a manner that violates Instagram's Terms of Use or Community Guidelines.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.

10. Intellectual Property

The Service, including its design, code, features, logos, and documentation, is the intellectual property of Reelactive and is protected by applicable intellectual property laws. These Terms do not grant you any right to use the Reelactive brand, trademarks, or logos without our prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• Reelactive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Our total liability to you for any claims arising from the use of the Service shall not exceed the amount you have paid to Reelactive in the 12 months preceding the claim.
• We are not responsible for any actions taken by Instagram/Meta that affect your account or content published through our Service.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state, without regard to conflict of law provisions. For users outside the EU, disputes shall be resolved under the laws applicable to the jurisdiction where Reelactive operates.

14. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
